Trump Administration Insists Removal of Transgender Issues from Sex Education Programs, Multiple Jurisdictions Agree

At least eleven jurisdictions and two territories have agreed to a new directive from the federal government to eliminate references of transgender issues and the existence of transgender and non-binary individuals from a national sex education initiative, officials stated.

The government set a recent cutoff for stripping these mentions, threatening the loss of millions in federal funds. Almost every of the agreeing jurisdictions have GOP-led state legislatures and predominantly Republican governors.

Legal Challenges and Financial Disputes

Sixteen other states and Washington DC have filed a lawsuit against the government's requirement, arguing it infringes on Congressional authority, which created the $75m sex education program, known as the Personal Responsibility Education Program (Prep).

All jurisdictions participating in the legal challenge are led by Democratic governors.

In a recent court order, a federal judge prevented the Department of Health and Human Services (HHS), which oversees the program, from withholding financial support to the Democratic states if they refuse to comply.

“HHS fails to show that the new grant conditions are justified, let alone offer any valid reason, other than an excuse, for its actions,” wrote Ann Aiken, a federal jurist in the state. “The department offers no proof that it made informed determinations or took into account the statutory objectives.”

Initiative Aims and Government Scrutiny

The program seeks to inform adolescents on healthy relationships and how to prevent pregnancy and the transmission of STIs.

In April, the federal government demanded all jurisdictions receiving Prep funds to submit a copy of their curriculum to HHS and its subsidiary, the Administration for Children and Families, for a health content assessment.

By late summer, the administration sent letters to numerous jurisdictions, informing them that, during the evaluation, it had found “content in the curricula that fall outside the scope of the program's legal framework.”

In particular, the government said it had identified evidence of “gender ideology,” a term often used by rightwing factions to refer to the idea that gender is a changeable social construct and that trans and non-binary people are real.

Specific Examples of Requested Changes

The government instructed Illinois to remove a lesson that said: “Adolescents may identify in ways that differ from their assigned gender.”

It told another state to delete a line from a educational module that read: “Individuals regardless of identity need to know how to avoid unplanned pregnancy and infections.”

Moreover, health instructors in many jurisdictions could no longer be told to “show tolerance and understanding for all students, regardless of individual traits, including ethnicity, cultural background, religion, economic status, sexual orientation or gender identity,” based on the notices sent to jurisdictions.

Government Comments and State Responses

“Oversight is imminent,” declared a federal official, interim leader of the Administration for Children and Families, in a announcement. “Federal funds will not be used to negatively influence of the next generation or promote harmful political doctrines.”

Several states and territories confirmed they would remove the content or had completed the process. These consist of eleven specific states, as well as the two territories.

Another pair of jurisdictions, the states, said their Prep curricula never included the terminology mentioned in the administration’s letters.

Effects on Adolescents and Mental Health

Together, these jurisdictions are inhabited by over 120k trans people aged 13 to 17, based on projections from a university department.

“When the aim is to support youth and give them a safe space, I’m not sure why we are targeting the at-risk teenagers in the community,” commented an advocate, who leads an organization that provides sex education in one state.

“When the government says that there’s something wrong with you and the teachers aren’t allowed to provide information or they have to disclose your identity to family – when you know that that’s not safe – that’s detrimental to psychological well-being.”

Nearly half of trans and non-binary youth contemplated self-harm in the past year, based on a 2024 survey from a mental health organization. Educational backing for these adolescents is associated with lower rates of attempted suicide, the organization found.

Earlier Incidents and Continuing Conflicts

Previously, the federal government instructed California to remove references to gender identity from its Prep curriculum.

When the Democratic-led state declined, the government withdrew its funding, cutting approximately $12m in government money and stopping health initiatives in educational institutions, youth centers and group homes for foster children.

The state agency is challenging the withdrawal. To date, it has been unable to replace the lost funding.

The Trump administration has also informed instructors who receive money from two other federal sex education initiatives, the $50m SRAE program and the $101 million Teen Pregnancy Prevention Program (TPPP), that they may not teach about “gender-related concepts.”

An early October judicial ruling blocked the government from altering one program, while the Monday court order stops it from changing SRAE in the suing jurisdictions that challenged Prep.

The Administration for Children and Families did not provide a prompt reply to a request for comment.
